Orleans Homebuilders, Inc. is no longer in the homebuilding business., As of July 20, 2015, Orleans sold its remaining lots and land in North Carolina, South Carolina and Illinois to Taylor Morrison. On December 8, 2015, Orleans sold most of its remaining land and lots in Pennsylvania, New Jersey and New York to Lennar. As part of these sales, neither Taylor Morrison nor Lennar assume any liability for homes constructed by Orleans. That liability, if any, remains with Orleans. Prior to these sales, on March 10, 2010, Orleans and its related companies (including all of its homebuilding entities) filed Chapter 11 bankruptcy cases in the United States Bankruptcy Court for the District of Delaware, which cases are jointly administered under Case No. 10-10684 (KJC). The companies’ Plan of Reorganization dated November 29, 2010, was confirmed by an order of the Bankruptcy Court dated December 1, 2010 and became effective February 14, 2011. The Plan and the Confirmation Order provide that most claims against Orleans that arose prior to February 14, 2011 (including for construction work completed prior to that date) have been discharged, and Orleans is no longer responsible for any such claims. That means that if your home was constructed by Orleans on or before February 14, 2011, you do not have any claims against Orleans. The assertion of any such claims would be a violation of the Bankruptcy Court’s Confirmation Order. However, you still may have a claim with Residential Warranty Company.
